Hello!

These two flies (3.5-4 mm) are from the same time on the same plant near a small pond in our garden (northwest Germany). Are they male and female of the same species?

Please, note that the top one probably is another species. It appears to be Protoclythia rufa. I missed that first image initially. Angry
