I wonder if it is trying to mimic a harmless Chironominae. Chironominae hold their front legs the same way: femur vertical, rest of leg usually straight ahead. Some flies hold their fore legs out to mimic Ichneumonidae (parasitic wasps), but usually have pale bands on their legs.
