I have seen into some other threads on forum and I think I was wrong with my first identification.
In this momemnt I don't try to identificate this fly. I attach other photo that shows very small abdomen of it.

If everybody keep silence, I think Lauxaniidae, Sapromyza(?)

I read some threads about Sapromyza and I have second thought. Based on this: http://www.diptera.info/forum/viewthread.php?forum_id=5&thread_id=6073 I understand Sapromyza don't has presutural dc. Is it not presutural dc? I'm right or wrong?

You are right. I'm wrong - it is presut dc and it is Meiosimyza.
