A very small insect!+

Hello,

I hope, someone can help me to identify this small insect. It was 4 to max. 5 mm and in the sunshine it was black. I found it on 4. Mai 2007 in my garden on a ligustrum leave in Land Salzburg, near the NP Hohe Tauern. it?s look like, that she was dancing on the leave.

It looks to Pipunculidae maybe... or Sepsidae?
