If you look at that key http://www.dipter...w_2011.pdf, part Eristalis, you find the important characters to distinguish between the species. Many of them are not seen in this sole picture. With certainty it is not E. pertinax (no yellow fore feet). There might be the two hair bands on the eyes that would make it E. tenax, but I am not fully convinced, my E. tenax specimens were not so colourful... Do you have a high magnification shot of the head?
