 Black mysterious fly

Hello, A few days ago, I saw this totally black fly, waving the wings, but could only take those two pictures. Paris, 2008/5/19, about 8-9 mm I got the impression that this is not a fly I commonly see in my own park (the cemetery). Does this ring a bell?
