A little dark fly, 4-5mm, seen next to blossoming Solidago gigantea on which there was a rich variety of insects.
In dense undergrowth on the banks of a well wooded stream.

Maybe you are right. I had hesitated because of the slight bent of the M-vein, but then the proboscis on pic #2 convinced me - too quick, I think now.
