Hello! This one looks like a Heleomyzid (Tephrochlamys?) to me, but it was only slightly larger than a bigger Drosophila, only 3,5-4 mm. On the second pic it did not fly away, it was "waving" with its wings several times. Found at our house yesterday (Ostwestfalen/Germany).
