black Drosophila ?

Hi flyforum, This little fly looks some 'Drosophila' to me. The lifted scutellum is a bit obviously, I didn't mention this before. When I compare this Drosophila(?)fly with a D. Subobscura which I watched before on this place, the abdomen are quite different! Is this a sex-different? (male perhabs?) Also the face is more white.. Strange Tarsus first leg!!
