I think it's an acalyptrate. Reminds me of this unidentified fly from Massachusetts http://bugguide.n...08/bgimage.

You're right for the one from Massachusetts. I hadn't noticed the preapical bristle on the mid tibia. Matches one of the local species of Melanomyza (Lauxaniella).
