Please, can comeone help me to identify this fly (or even spider)?

Size: cca 2.5 mm?
Habitat: light forest with oaks, cherries and black locusts
Slovakia, Kosice, 300 m a s.l., July 2005

Spider prey is probably Formica sanguinea. The fly seems to be very impertinent, it feeds literally from spider mouth, :).
