It is a calyptrate fly (I leave it to other to put a name on). You can see that it is a true fly by the shape of the antennae: three larger segments with a hair-like arista on the third and largest segment. Bibionidae are actually midges and they have antennae with 6-7 segments that all are alike. Under the wing you can see a small membranous part that is the calyptra 9identifying it as a calyptrate fly).
