Perhaps a very dark D. suzukii but without a view of the ovipositor I cannot be certain. I think not 'black' enough for subobscura.

Male D. funebris? The mid-brown mesonotum combined with pale and long (for a Drosophilid!) legs. Abdomen is very dark though.
