This fly resembles
Neria cibaria (gallery photos) a lot. Could it be that species? I photographed it this afternoon at Leerdam, Netherlands. It was about 8-10 mm long and was walking on leaves all the time.

I'd be happy with that identification. The general appearance is right for
Neria and the ovipositor sheath typical of
Neria. In
N.cibaria there is a dorsolateral constriction of the ovipositor sheath as your picture illustrates. It's always worth sticking around and looking for a male; the genitalia are much easier to use for identification and there are frequently 2 or more species in the same location.
