Is it ephydridae?

It's a Notiphila. Cranefly is far better than me on these! ;)

Antennae with 1-2- segments black, apical segment yellow but darkened, fore tibia dark except the apices, mid and hind tibia with black bands, abdominal tergites with 2 spots. Cheeks relatively narrow. If so - then it is - Notiphila annulipes Stenhammar B)

really, tibiae look dark without bands. Let's try once more.
1) antennae - all segments yellow or 1-2 segments black, apical segment yellow but darkened ?
2) abdomen with 2, not 4 spots on tergites?
3) relation of height of eye/height of cheek (lateral view) about 5-6:1 or 4:1 or 3: 1?:)
