Thanx... but... I tought E. pertinax should have a yellow band on the abdomen, like seen on this picture:

BTW, is the 1st posted a male and the latter a female? I ask mainly becoz of the eyes, but does the yellow band also have something to do with the sex of the fly?

the yellow tarsa of the first leg is characteristic for E. pertinax, the colour of the abdomen might be variable.
indeed in the first two photos you have a male and in the last one a female
