Hello!

Two small flies from December-01 (Ostwestfalen/Germany). #1 (only 4-5 mm) sat at a pine in our garden at night, #2 (5-6 mm) in moss at an apple tree on a meadow at day. Are both Tephrochlamys sp.? Thanks!

Somewhat larger pictures of both:

The first one is Tephrochlamys sp., the second is a member of the Heleomyzini in the sense of Gorodkov 1984.
