Hello,
I'm not sure, and the Photos are not the best. In Insektenfotos.de there were also a possible meaning Physophora alceae

The fly was ca. 4 mm small under a leaf of Topinambur on October 13. in Frankfurt /M - Central Germany.

Interesting are the red/orange eyes and also the first pair of black legs.

I would say aeneum/simillimum is then best you can do from these photos
